Stana Emmerson, representing the owner: Gina Nikolayevich, is proposing to repair a house that was damaged by fire and rendered uninhabitable on a property located at 35495 Myelle Road in Franklin Township. The 5-acre property is zoned A-1, Agricultural District, and the house was a pre-existing, legal, non-conforming use. The Zoning Ordinance allows that a Building Permit to repair the damage to a legal, non-conforming house may be granted, provided an application is made within 180 days of the date of the damage. The damage occurred on January 21, 2015, however, no such application was submitted within the 180-day time period. In order to repair the house on the property, a Variation must be granted from the 180-day requirement. Before a Variation can be granted, a public hearing must be held by the DeKalb County Hearing Officer.

 

Stana Emmerson has requested such a Variation for the property located at 35495 Myelle Road, Kingston, IL 60145. A public hearing will be held by the DeKalb County Hearing Officer on Thursday, June 1, 2017, at 1:00 p.m. in the DeKalb County Administration Building, East Conference Room, south entrance, 110 E. Sycamore St., Sycamore, IL 60178. All interested persons are encouraged to attend and be heard, as this will be the only opportunity for public input on the application. The application for Variation, Petition FR-17-7, is available for inspection at the DeKalb County Community Development Department, 110 E. Sycamore Street, Sycamore, IL, (815) 895-7188.

 

The subject property is zoned A-1, Agricultural District, and is legally described as follows:

 

The East 822.02 feet (as measured along the North line thereof) of the North 265.0 feet (as measured along the East line thereof) of the Southeast Quarter of Section 1, Township 42 North, Range 3 East of the Third Principal Meridian, in Franklin Township, DeKalb County, Illinois.

The requested Variation is from Section 8.03.C.3.a of the DeKalb County Zoning Ordinance, in order to waive that portion of the regulation that states that a building or structure containing a nonconforming residential or church use, where such nonconformity was created by government action and not action(s) of the current or previous owner(s), which is damaged to any extent and by any means may be rebuilt, provided an application for a Building Permit is submitted within 180 days from damage date.
