Public Hearing

The DeKalb County Sherriff's Department is proposing to construct a 350 foot tall communication tower on property located on Miller Road, approximately 1170 feet west of Waterman Road, in Afton Township, as part of their upgrade of the DeKalb County 911 System. The property is zoned A-1, Agricultural District and communication towers are a Special Use Permit in that district. The proposed tower requires the approval of a Special Use Permit. Before a Special Use Permit can be approved by the DeKalb County Board, a public hearing must be held before the DeKalb County Hearing Officer. Additionally, the DeKalb County Zoning Ordinance requires that towers greater than 200 feet in height have a setback from the road equivalent to at least 90% of the height of the tower. The proposed tower would require a setback of at least 315 feet, however, the tower as proposed will not meet that setback. In order to allow the proposed tower to be located less than 315 feet from the road, a variation from this standard must be granted. Before such a variation can be granted, a public hearing must be held by the DeKalb County Hearing Officer.

 

The DeKalb County Sherriff's Department is requesting approval of Special Use Permit and a Variation for the proposed communication tower on Miller Road, Kirkland. A public hearing will be held before the DeKalb County Hearing Officer on Thursday, May 17, 2018, at 2:00 p.m. in the DeKalb County Administrative Center, Conference Room East, 110 E. Sycamore Street, Sycamore, IL, 60178. Because this will be the only opportunity for public input on this application, all interested persons are encouraged to attend and be heard. The Special Use Permit petition, AF-18-9, is available for inspection at the DeKalb County Community Development Department, 110 E. Sycamore Street, Sycamore, IL, (815) 895-7188.

 

A part of Section Thirty-three (33), Township Thirty-nine (39) North, Range Four (4), East of the Third Principal Meridian, described as follows: Commencing at the Southwest comer of the Southeast Quarter of said Section Thirty-three (33), which point is marked by existing stone; thence Easterly along the South line of said Southeast Quarter of Section Thirty-three (33), a distance of One Thousand Three Hundred Twenty-seven and eight tenths (1,327.8) feet to the point of beginning which point is the point of intersection of said Section line and the Southerly extension of the line of a fence marking the occupation claim line between the Southwest Quarter and the Southeast Quarter of the Southeast Quarter of said Section Thirty-three (33); thence Northerly at an angle of 91 degrees 03 minutes measured clockwise from last described course along said fence line, a distance of Two Hundred Forty-one and seventy-one hundredths (241.71) feet; thence Easterly at an angle of 91 degrees 03 minutes measured counter-clockwise from the last described course (parallel to South line of said South East Quarter of Section Thirty-three (33)), a distance of Two Hundred Eight and seventy-one hundredths (208.71) feet to a point; thence Southerly at an angle of 88 degrees 57 minutes measured counter-clockwise from the last described course (parallel to the fence line occupied as a claim line between the Southwest Quarter and the Southeast Quarter of said Southeast Quarter of Section Thirty-three (33)), a distance of Two Hundred Forty-one and Seventy-one hundredths (241.71) feet to a point on the South line of said Southeast Quarter of Section Thirty-three (33); thence Westerly along the said South line of the South East Quarter of Section Thirty-three (33), a distance of Two Hundred Eight and seventy-one hundredths (208.71) feet to the place of beginning, situated in the County of DeKalb in the State of Illinois.

Subject to the rights of Commonwealth Edison Company, its successors and assigns, reserved in deed to premises above described from said Company to Russell V. Dondanville, dated November 10, 1966 and recorded November 28th 1966, as Document No. 335853, being the perpetual right, easement and authority to Construct, install, use, operate, maintain, repair, replace, renew and remove poles, cross arms, wires, cables, dram guys, anchors, conduit, manholes and other overhead and/or underground equipment and facilities, for the transportation and distribution of electrical energy, in, upon, over and under the South 50 feet of the premises above described, with the right of access thereto at all times, and also the right to trim, cut and remove from time to time, such trees, shrubs, bushes and saplings as may be required incidental thereto, over and under the South 50 feet of premises in above described, situated in the County of DeKalb, in the State of Illinois , hereby releasing and waiving all rights under and by virtue of the Homestead Exemption laws of this state.

The application for the Special Use Permit has been filed in accordance with the requirements of Section 9.02 of the Zoning Ordinance in order to approve the construction of a communication tower on property zoned A-1, Agricultural District, and to approve a Variation from Section 4.02.C.1.u of the Zoning Ordinance to allow a 350 foot tower to be located less than 315 feet from a roadway.
