Bad Check Restitution Program

 

As DeKalb County State's Attorney, I am committed to combating the negative impact of bad checks passed to local businesses. In order to deal with this problem, a Bad Check Restitution Program has been instituted to assist local merchants in recovering funds from bad check writers. The primary goal of the program is to obtain full restitution for the victim without adding to the financial burden of the criminal justice system. To that end, 1st time bad check offenders are given the opportunity to avoid criminal prosecution by attending a mandatory intervention class, in addition to paying restitution. Enrollment in the program is not an admission of guilt to a crime, and will not result in criminal charges being filed or a criminal record. All of this is accomplished without any cost to the taxpayers.


Millions of dollars are lost every year by merchants as a result of this growing problem. Bad checks affect everyone in terms of higher consumer costs that must be passed on to offset losses, and increased taxes to cover the additional costs for law enforcement and prosecution. If merchants can be compensated for their losses and bad check writers prevented from falling back on old habits our entire community will benefit.
